Grace Period of Use
Within the grace period of use a trademark owner is exempt from the duty to proof use of the mark. The five years period is counted from the date of registration of the mark. In the event that the mark was formally opposed the period is counted from the date of which all oppositions were resolved.
Thereafter, if the mark is not used for any period of five consecutive years, it becomes vulnerable to cancellation.
